These Terms of Service (“Agreement”) govern your use of Asushost’s web hosting, domain registration, reseller hosting, email, and related services (“Services”). By purchasing or using our Services, you agree to be legally bound by this Agreement.
1. Eligibility
You must be at least 18 years old to purchase our Services.
By registering an account, you confirm that the information provided is accurate and up to date.
2. Services Provided
Web Hosting, Reseller Hosting, VPS, and Dedicated Servers.
Domain registration and management.
SSL Certificates, WHMCS, and related add-ons.
Email hosting and security solutions.
We reserve the right to modify, improve, or discontinue any Service with prior notice.
3. Acceptable Use Policy (AUP)
By using our Services, you agree NOT to engage in the following:
Hosting or distributing malware, phishing sites, or spam.
Sending unsolicited bulk email (spam) or abusive traffic.
Hosting illegal content including child exploitation, terrorism, pirated software, copyrighted material without authorization, or any content prohibited by Kenyan Law or international regulations.
Using the Services for money laundering, fraud, or cryptocurrency mining without approval.
Violation of this AUP may result in suspension or termination of Services without refund.
4. Payment & Billing
All payments must be made in advance for the selected billing cycle (monthly, quarterly, annually).
We accept payments via M-Pesa, Bank Transfer, Debit/Credit Cards, and PayPal.
Invoices not paid within 7 days of due date may lead to suspension of Services.
Prices are subject to change with 30 days prior notice.
5. Data Protection & Privacy
We comply with the Kenya Data Protection Act, 2019.
Customer data is stored securely and will not be shared with third parties except as required by law or for provision of Services.
Customers are responsible for maintaining the confidentiality of their login credentials.

6. Backups & Data Responsibility
We provide automated backups on selected plans, but we do not guarantee full recovery in all cases.
Customers are responsible for maintaining their own backups of files, databases, and emails.
Asushost shall not be liable for data loss caused by customer actions or external attacks.
7. Service Level Agreement (SLA) & Uptime
We provide a 99.9% uptime guarantee on hosting services.
Scheduled maintenance will be communicated in advance.
Downtime caused by third-party software, customer misconfigurations, or force majeure events is not covered under SLA.
8. Suspension & Termination
We may suspend or terminate accounts for:
Violation of the AUP.
Non-payment of invoices.
Legal orders from government authorities.
Terminated accounts are not eligible for refunds except under the 30-Day Money Back Guarantee (if applicable to the plan).
9. Limitation of Liability
Asushost shall not be liable for indirect, incidental, or consequential damages including loss of data, profits, or business opportunities.
Our maximum liability shall not exceed the amount paid by the customer for the last billing period.
10. Governing Law
This Agreement shall be governed by the Laws of Kenya, under the jurisdiction of the Courts of Nairobi, Kenya.
11. Amendments
We may update these Terms at any time. Customers will be notified of major changes via email or our website. Continued use of Services constitutes acceptance of updated Terms.
